STAICY TERMS & CONDITIONS

1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Staicy platform, including the Staicy website, dashboard, mobile applications, and any related services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility

Staicy’s services are intended solely for users who are at least eighteen (18) years of age and who live in a geographical location where Staicy’s services are legal.

By using the Platform, you represent and warrant that:

  • You are at least 18 years old; and
  • Your use of the Platform complies with all applicable laws in your jurisdiction.

3. Nature of Services

Staicy is a sports data and analytics platform.

Staicy:

  • Does not accept wagers
  • Does not process bets
  • Does not handle funds
  • Is not a sportsbook, casino, or gambling operator

All content, predictions, models, and analytics are provided for informational and entertainment purposes only.

There are no guarantees, no “locks,” and no assurances of outcomes or profitability.

4. No Advice or Guarantees

Sporting events are inherently unpredictable. Outcomes may differ materially from predictions.

Nothing provided by Staicy constitutes financial, legal, or gambling advice. Users are solely responsible for how they use information provided through the Platform.

Staicy assumes no liability for decisions made by users based on Platform content.

5. Subscriptions, Free Trial, and Billing

5.1 Subscription Plans

Staicy offers:

  • $199.00 per month; or
  • $1,999.00 per year

All subscriptions include a seven (7) day free trial.

5.2 Billing

  • Users are billed automatically on the 8th day following sign-up. The day a user begins the free trial is Day 1. For example, if a user signs up on Monday the 1st, the free trial will end on Sunday the 7th at midnight. The user will be billed Monday the 8th.
  • The billing date becomes the recurring monthly or annual billing date until canceled.
  • Payments are processed via Finix.

5.3 No Refunds

All payments are final.

Staicy offers no refunds, except where required by applicable law.

By subscribing, you acknowledge that meaningful value is delivered immediately upon access.

6. Cancellation

Users may cancel their subscription at any time. Cancellation prevents future charges but does not entitle the user to a refund for any previously billed period.

7. Intellectual Property

All Platform content, including models, analytics, text, graphics, logos, and software, is the exclusive property of Staicy Inc. or its licensors.

No rights are granted except as expressly stated.

Staicy is not affiliated with, endorsed by, or associated with any sports league, team, or governing body.

8. Prohibited Conduct

Users may not, directly or indirectly:

  • Scrape, crawl, or extract Platform data
  • Redistribute, publish, or share Staicy Picks or outputs prior to the start of any contest including the published player or betting market without express written, notarized consent from Staicy Inc.
  • Use Platform content for commercial resale
  • Use Staicy content to operate or support a betting service

8.1 Monitoring & Enforcement

Staicy reserves the right to conduct testing and monitoring to detect violations.

8.2 Liquidated Damages

Any violation of this Section constitutes irreparable harm.

Users agree to liquidated damages of $20,000.00 per violation, which the parties agree represents a reasonable estimate of harm and is not a penalty.

9. Telegram & Third-Party Communities

Staicy may invite users to join private third-party communities, including Telegram.

Staicy:

  • Does not monitor user communications
  • Does not endorse user statements
  • Disclaims all responsibility for content shared therein

Participation is entirely at the user’s own risk.

10. Limitation of Liability

To the maximum extent permitted by law:

Staicy’s total liability shall be limited to actual damages, and in no event shall exceed the amount paid by the user to Staicy in the three (3) months preceding the event giving rise to the claim.

Staicy shall not be liable for indirect, incidental, consequential, or punitive damages.

11. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

Staicy disclaims all warranties, express or implied.

12. Mandatory Pre-Suit Mediation

Prior to filing any lawsuit, the parties shall participate in in-person mediation in Kentucky.

  • Costs shared equally
  • Mediator selected by mutual agreement
  • If no agreement is reached within ten (10) days, the mediator shall be selected by random draw from mediators listed on the National Academy of Distinguished Neutrals (NADN) website for Kentucky

Failure to mediate bars litigation. By using the Staicy Platform, users agree there is no right to suit prior to completion of mediation, as outlined in this section. By using the Staicy Platform, users agree to immediately dismiss with prejudice any suit brought prior to mediation.

13. Governing Law & Venue

13.1 Governing Law

These Terms shall be governed exclusively by Kentucky law.

13.2 Venue

Any action shall be brought exclusively in Kentucky state court, in Bullitt County Circuit Court, Shepherdsville, Kentucky.

Federal jurisdiction is expressly waived.

13.3 Attorney’s Fees

Each party shall bear its own attorneys’ fees.

14. Class Action Waiver

Users waive any right to participate in a class, collective, or representative action.

15. Modifications

Staicy may modify these Terms at any time. Continued use constitutes acceptance.
